1. This Usage Policy sets out Redstor’s general terms for all customers using our Services and you agree to comply with the same when using our Services. This Usage Policy is part of the Redstor customer License Agreement (“EULA”) and is governed by the terms of the EULA. All defined terms in the EULA apply. This Usage Policy applies from August 2024.
2. The bandwidth, storage, infrastructure and resources that we make available in delivering each Service are shared across all our clients. As a result, we reserve the right to take measures to ensure that all clients can enjoy each Service appropriately. We may impose rules for the use of the Service to combat fraud, ensure that use of each Service is not excessive and/or to ensure that clients use each Service reasonably and fairly and that such use does not interfere with or prevent normal performance of each Service for other clients. Examples of breaches of this Usage Policy would be if your average consumption per seat is abnormal compared to other clients in a similar situation or if you do not follow our recommendations/process when backing up your data and that abnormally increases the quantity of your data that is stored,
3. Neither you nor your Authorised Users may at any time access, store, distribute or transmit any material via the Service:
3.1that is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive;
3.2that facilitates illegal activity;
3.3 that depicts sexually explicit images;
3.4that promotes unlawful violence;
3.5that is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; or
3.6 in a manner that is otherwise illegal or causes damage or injury to any person or property;
4. If we, acting reasonably and in good faith, consider your use of the Service is not reasonable or is contrary to this Usage Policy, we reserve the right, at our sole discretion, and notwithstanding anything to the contrary set out in the EULA or this Usage Policy to take one or more of the following measures:
4.1Temporarily suspend your use of the Service (including backups of your data) until the matter is resolved with you;
4.2allow you to continue to use the Service subject to payment of additional fees based on your use and your compliance with any terms that we may consider reasonable in the circumstances;
4.3 notify you that your account will be terminated within a timeframe reasonably set at our discretion. During such the termination notice period, backups of your data will be suspended but fees will continue to be payable.
5. If we exercise our right to terminate your account:
5.1Your Backup Data will be deleted at the end of the timeframe set out by us in the termination notice we send you (but not less than 30 days); and
5.2 We will refund you pro rata any fees prepaid to us in advance for the remaining term of your subscription period.
Service Specific Terms:
Redstor Pro
1. The Redstor Pro/RBUSS hosted Service (“Service”), managed and maintained by Redstor, provides an online storage platform which enables you to Back up a specified Device (“Device”) to Redstor’s Service Platform (“Service Platform”). The associated software that is provided by Redstor to enable the use of the Service (“Software”) allows automated or manual backup, as well as your own initiated data recovery.
2. Backups can be scheduled to run unattended at a particular time or at a frequency defined by you. Before leaving your device, the Software shall compress your data (“Data”) and transfer the Data over a secure SSL connection to the Service Platform. If you have subscribed to Redstor’s storage services,a copy shall then be held at two of Redstor’s appointed Data Centres. Data is stored in an encrypted format (256 bit AES) on the Service Platform and remains so until recovered by you.
3. Only files that have been modified or added since the last backup will be identified for backup by the system. Data is transferred via any TCP-IP enabled network connection, over TCP port 443.
4. The Software will undertake backup using advanced compression and efficiency algorithms. Changes to a file are extracted at a sub-file level so that if a document is edited, only the changed bytes of that document will be extracted and sent to the Service Platform. This process allows the Software to communicate only necessary file changes, rather than having to re-send an entire file to the Service Platform. A full copy of the most recent data is kept available for immediate recovery. At least one calendar month of backups will be kept online.
5. You must install the Software on each Device and Redstor shall provide technical support to you in line with the SLA. The Software has a number of hardware and software requirements and Redstor shall provide details of such hardware and software requirements prior to installation. You are responsible for ensuring that the Devices meet the requirements.
6. One set of Security Credentials (username, password and encryption key) are required for each Device, and the Security Credentials may not be shared between Devices.
7. The backup username and password can consist of any keyboard combination between 4 and 20 characters. The encryption key can be any keyboard combination between 8 and 56 characters. The encryption key is used when the encryption algorithm encrypts files to keep data confidential. Without the encryption key, no one can access the Data.
8. Backups shall run unattended by Redstor in accordance with the times and frequencies set by you. Redstor shall keep all Data available for immediate recovery by you on disk for at least one calendar month. Redstor will ensure that Data restores can be initiated by you at any time via the Software.
9. All recoveries of Data are your responsibility and except in the situation of an Emergency Recovery, are offered online only. For a situation of emergency recovery as defined by Redstor (“Emergency Recovery”), suitable arrangements must be made to recover data from Redstor’s data centre.
10. Redstor will undertake specific Emergency Recoveries in accordance with its then current schedule of charges or as otherwise notified by Redstor. Data can be copied locally at the data centre and shipped at cost, to a site of your choice for direct recovery. You shall have the option to collect Data from Redstor using your own preferred couriers. In these instances, no charge shall be made by Redstor for shipping costs.
11. For all Emergency Recoveries, you must provide a Purchase Order number or written confirmation of the request for this service in advance of any local recovery being instigated and agreement to the costs incurred. Redstor will invoice you for the full amount following recovery whether successful or unsuccessful.
12. As part of the Service provided to you, you will have access to a management platform that enables you to monitor and control the Software and Backups centrally.
13. You are not permitted to remove data, hardware or software components physically from any data centre owned or rented by Redstor or its partners.
